Decentralization in Healthcare: The Tension Between Territorial Autonomy and Centralization Under the 1991 Constitution

Introduction: This study analyzes the tension between the principle of territorial autonomy and state centralization within the Colombian healthcare system. Objective: To determine whether decentralization has effectively strengthened the autonomy of local government entities in healthcare. Methodology: Conducted under a qualitative approach with a documentary and hermeneutic design, this study applies a PRISMA-type systematic review and a normative-jurisprudential analysis. It examines regulatory transformations and public policies between 1991 and 2025, based on the 1991 Constitution, laws governing the General System of Participations and the General System of Social Security in Health, as well as relevant rulings from the Constitutional Court. Results: The findings show that despite regulatory and fiscal progress, an operational recentralization in healthcare decision-making persists, accompanied by limited local institutional capacity and weak intergovernmental coordination. Theoretical and jurisprudential stances converge, showing that decentralization has been more formal than substantial. Conclusions: To guarantee the right to health with territorial equity, it is necessary to reform competencies, strengthen subnational institutional capacities, and advance toward a cooperative governance model.
